Terms of Service

By accessing or using AnZi.AI (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the App. These Terms constitute a legally binding agreement between you and AnZi.AI (“we,” “us,” or “our”).

1. Eligibility

You must be at least 18 years old to use the App. By using AnZi.AI, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3. Your Content and the Rights You Must Have

You Keep What You Upload

You retain all rights to the prompts, product photos, brand assets, scripts, and other media you upload to the App (“User Content”). We claim no ownership over it.

You Must Have the Rights to It

You represent and warrant that, for all User Content you upload, you own it or hold all licenses, rights, consents, and permissions necessary for us and our AI service providers to process, store, and generate content from it.

Do not upload material you do not have the rights to use. This includes, without limitation:

• Photographs, illustrations, or footage you found online or that belong to someone else
• Stock imagery you have not licensed for this purpose
• Another company’s product photography, packaging, logos, or trademarks
• Photographs or recordings of any identifiable person who has not consented to this use
• Characters, artwork, music, or designs protected by copyright or trademark

You grant us a limited, non-exclusive licence to host, process, and transmit your User Content solely to operate the App and produce the output you request.

4. AI-Generated Content

AnZi.AI uses artificial intelligence to generate images, videos, and other content (“Generated Content”). Regarding Generated Content:

• Subject to your active subscription and these Terms, you receive a non-exclusive, worldwide licence to use Generated Content for commercial and personal purposes
• We do not guarantee that Generated Content will be unique, or that similar content has not been generated for other users
• We do not warrant that Generated Content is free of third-party intellectual property rights. AI models can produce output resembling existing works. You are responsible for reviewing Generated Content before you publish or distribute it, and for ensuring that your use complies with applicable law and does not infringe the rights of others
• AI-generated avatars and voices are synthetic representations and must not be used to impersonate real individuals without their consent

5. Acceptable Use and Prohibited Content

AnZi.AI is a tool for creating marketing content. You may not use it to create, upload, request, store, or distribute any of the following (“Prohibited Content”):

• Child sexual abuse and exploitation. Any content that sexualises, exploits, or endangers a minor, whether real, synthetic, or stylised. We have zero tolerance for this. We remove it, terminate the account, and report it to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement.
• Sexually explicit content. Pornography, nudity intended to arouse, sexual acts, and sexually explicit depictions of any person. This includes non-consensual intimate imagery of real people.
• Graphic violence. Gore, torture, mutilation, or content that glorifies or incites violence, terrorism, or cruelty to people or animals.
• Hate and harassment. Content that attacks, demeans, or promotes hatred against people on the basis of race, ethnicity, religion, disability, age, nationality, sexual orientation, gender, gender identity, or any other protected characteristic; and content that bullies, threatens, or harasses an individual.
• Self-harm. Content that promotes, glorifies, or provides instruction for suicide, self-injury, or eating disorders.
• Deceptive media and impersonation. Deepfakes and synthetic media that depict a real person doing or saying something they did not, or that impersonate a real person, brand, or organisation without their consent. AI avatars and cloned voices may only be used with the consent of the person depicted.
• Illegal and regulated goods. Content that promotes or facilitates the sale of illegal drugs, weapons, counterfeit goods, or other unlawful products or activities.
• Intellectual property infringement. Uploading material you do not own or have the rights to use, or generating content that infringes the copyright, trademark, or other rights of others.
• Misinformation. Content designed to mislead about elections, public health, or emergencies.

You also agree not to:

• Distribute spam, malware, or other harmful material
• Attempt to bypass, disable, or reverse-engineer our content safeguards, models, or algorithms
• Use automated means to access the App beyond normal usage
• Circumvent usage limits, credits, or subscription restrictions
• Resell or redistribute access to the App without authorization

5A. Content Safeguards, Reporting, and Enforcement

Safeguards. Prompts are screened before generation and requests for Prohibited Content are refused. The AI models we use apply their own content filters as well. These safeguards are not perfect, and Generated Content that violates these Terms may occasionally be produced.

Reporting. You can report any AI-generated content from inside the App without leaving it: open the content and tap the flag icon (“Report this content”), or long-press a campaign in your library and choose Report content. Choose the reason that best describes the problem and submit. Reports are confidential.

What happens next. Reported content is hidden and cannot be exported, shared, or published while it is under review. Our team reviews every report, usually within 24 hours; reports involving child safety are prioritised and escalated immediately. Content found to violate these Terms is removed. If the report does not identify a violation, the content is restored.

Enforcement. We may remove Prohibited Content, refuse generations, and suspend or terminate accounts that violate this section, with or without notice, and without refund of unused credits. We cooperate with law enforcement where required by law. Repeated or serious violations result in permanent termination.

6. Your Indemnity to Us

You agree to indemnify, defend, and hold harmless AnZi.AI and its officers, employees, and service providers from and against any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or relating to:

• User Content you upload, including any claim that it infringes or misappropriates the intellectual property, privacy, or publicity rights of a third party
• Your use, publication, or distribution of Generated Content
• Your breach of these Terms or of any applicable law

7. Copyright Complaints and Takedown

We respect intellectual property rights and will respond to properly submitted notices of alleged infringement. If you believe content generated or hosted through the App infringes your copyright or trademark, contact us at support@anziai.com with:

• Identification of the work you say has been infringed
• Identification of the material in question and where it appears
• Your contact details
• A statement that you believe in good faith the use is not authorized, and that the information in your notice is accurate

We will review valid notices and may remove content and suspend or terminate the accounts of repeat infringers.

8. Subscriptions and Payments

AnZi.AI offers free and paid subscription plans. Paid subscriptions are billed through the Apple App Store or Google Play Store (“Platform Providers”) and are subject to their respective terms.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You may cancel at any time through your Platform Provider’s subscription management settings
• Refunds are handled according to the policies of your Platform Provider
• We reserve the right to modify pricing with reasonable notice

9. Credits and Usage Limits

Content generation consumes credits based on your subscription plan. Unused credits do not roll over between billing periods unless otherwise stated. We reserve the right to adjust credit allocations with reasonable notice.

10. Our Intellectual Property

The App, including its design, features, AI models, and underlying technology, is owned by AnZi.AI and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written permission.

11. Third-Party Services

AnZi.AI integrates with third-party services including social media platforms, AI service providers (such as FAL.ai and Replicate), and payment processors. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

12. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any warranty of non-infringement. We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Generated Content will meet your specific requirements or expectations
• Any errors or defects will be corrected within a specific timeframe

13. Limitation of Liability

To the maximum extent permitted by law, AnZi.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the App. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App’s settings. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.
